For the reason mention in the application, the delay in filing the application for bringing the legal heirs of deceased respondent no. 1-d) on record is condoned. Since, right to sue survives against the legal heirs of deceased respondent no.1-d) hence, order of abatement is set aside. Permission to bring the name of legal heirs of respondent no. 1-d) on record is granted.
