Against the order of termination the petitioner has taken recourse to the alternate remedy of approaching before the Labour Court.

The proceedings were answered in favour of the petitioner which is now the subject matter of challenge before the learned Single Judge in Writ Petition No. 1037/2019.

The said petition is informed to be still pending.

It is based on aforesaid service condition, the petitioner is claiming that he is not paid salary since 2019.

We are of the view that the petitioner has a remedy to seek such claim for release of salary in the pending petition of the employer being Writ Petition No.1037/2019.

That being so, we deem it appropriate to direct the Registry to treat this petition as a Civil Application in Writ Petition No.1037/2019.

7.

The Registry to take appropriate steps.

Leave to amend.

8.

Amendment to be carried out within a period of two weeks from today.

9.

Stand over to 17.07.2025.
