Condonation of delay is sought in filing the application for bringing legal heirs of deceased respondent no. 8 and setting aside the abatement order. 4.

For the reasons mention in the application and no objection given by the respondents, delay in filing the application is condoned. Since, the right to proceed against legal heirs of deceased respondent no. 8 survives, RR Jaiswal

By the present application, the learned counsel for the petitioner seeks to delete the name of deceased respondent no. 7 from the array of respondents.

Permission is granted to delete the name of respondent no. 7 at the risk of the petitioner. 8.

Amendment be carried out within two weeks from today.
