This is an application filed by the petitioner seeking permission to withdraw the amount deposited in this Court.

The contention is that, pending writ petition, vide order dated 28.02.2018, the petitioner was directed to deposit 50% of the backwages in this Court. The order has been duly complied with by the petitioner by depositing 50% backwages to the tune of Rs.1,26,959/-. It is further contended that now, the petition has been allowed and the orders passed by the Labour Court and the Industrial Court have been set aside by the common judgment and order passed by this Court (Coram : Anil L. Pansare, J.) dated 09.05.2025. The petitioner, therefore, prays for refund of the amount of 50% backwages deposited by it in this Court.

Since the impugned orders directing payment of backwages are set aside, the amount deposited by the petitioner be refunded to it, along with accrued interest, if any.

The civil application is allowed and disposed of accordingly.
