Condonation of delay is sought in filing the application for bringing legal heirs of deceased respondent no. 1 and setting aside the abatement order. 4.

For the reasons mention in the application and no objection given by Shri Kathane, learned counsel, delay in filing the application is condoned. Since, the right to proceed against legal heirs of deceased respondent no. 1 survives, the abatement order is set aside and permission is granted to bring their name on record.
