ORAL ORDER:

This is an application for confirmation of a Foreign Judgment/Decree granting Divorce to the Petitioner. The application has been filed under Article 1101 of the Portuguese Civil Procedure Code, read with Section 13 of the Civil Procedure Code. 2.
The Respondent was served vide WhatsApp and Speed Post pursuant to the order of this court dated 12.01.2026. An affidavit of service has been filed. Respondent Mr. Bonie Antonio Piedade Furtado is present in person and states that he does not wish to engage Counsel. He further states that he has consented to the Foreign Judgment bearing No.312/m/2021 passed by the Personal Status Court at Dubai. He further states that he has no objection for confirmation of the Foreign Decree and to the cancellation of the entry of his marriage with the Petitioner before the Civil Registrar of Salcete, at Margao, Goa. For the reasons to follow, the application is allowed.

The parties had registered their marriage before the Civil Registrar of Salcete, at Margao, Goa, and an entry to that effect has been made under No.1049/2006 dated 12.05.2006 in the Marriage Registration book of the year 2006.

Due to differences which arose between the parties, they mutually filed proceedings for dissolution of marriage registered in Goa, before the Dubai Courts of First Instance / Personal Status, in Case No.2021/700.

By a Judgement dated 16.12.021 by the Dubai Courts of First Instance / Personal Status, a Certificate of Judgement (Divorce) was issued to that effect.

On perusing the conditions of the decree passed, the same does not appear to be a Judgment passed based on a law contrary to the Public Policy of India and appears to conform with the laws of the land, as would be applicable to the parties, within the State of Goa. Consequently, the application is allowed. The decree dated 16.12.2021 by the Dubai Courts of First Instance / Personal Status is confirmed and held as final and conclusive.

The marriage of the Petitioner with the Respondent shall stand dissolved on the confirmation of this Foreign Decree. Consequently, the Civil Registrar Salcete at Margao, Goa, is directed to make appropriate endorsement against the No.1049/2006 dated
12.05.2006 in the Marriage Registration book of the year 2006, recording confirmation of the aforementioned Decree of Divorce and cancel such registration.

The order is made absolute in the above terms. 9.
The present application stands disposed of.
