This is an application for condonation of delay of 593 days in filing the statutory appeal by the original claimants, challenging the judgment and award dated 25.10.2023 passed by the Railway Claims Tribunal, Nagpur Bench, Nagpur.

In response to the notice issued on this application, Advocate Ms. Chaubey, appears on behalf of respondent.

Learned counsel for the applicants submits that the applicants are the dependents of deceased, who had died in the railway accident and they were not aware about the requirement of filing the appeal within the prescribed period of time. It is also submitted that some time was consumed in the process of acquiring necessary documents and arranging the amount for filing the appeal.

Having regard to the contents of the application and submissions advanced, the delay of 593 days does not appear to be intentional and the application needs to be allowed in the interest of justice. Accordingly, the civil application is allowed. Delay of 593 days in filing the statutory appeal is hereby condoned. First appeal be registered.
