This is an application in the disposed of appeal for withdrawal of the amount deposited by the Insurance Company in this Court under the Award passed by the Learned Motor Ancient Claims Tribunal, Gondia in MACP No 24 of 2012.

Heard the learned Advocate for the applicants/claimants and the learned Advocate for the Insurance Company.

My attention is drawn to the order dated 9th March 2021 by which the appeal is dismissed as withdrawn. There is no dispute that the Insurance Company has Kavita

2 / 2 49-caf-260-26 deposited the amount under the Award in this Court. In view of the dismissal of the First Appeal as withdrawn by the Insurance Company, the applicant No.1, who is the widow of the deceased Rajendra Hatwar is permitted to withdraw the amount along with interest accrued thereon as the applicant claimant No.2 Rajendra Hatwar, who was the father of the deceased is no more and the copy of death certificate is enclosed with the application. Since, the applicant No.1 Sanjaymala w/o Rajendra Hatwar is the resident of Gondia, at the request of the learned counsel for the claimants/applicants, the amount be transferred to the bank account of the Motor Accident Claims Tribunal, Gondia for further disbursal to the widow of the deceased. The learned Advocate for the applicants/claimants submits that the applicant No.1 Sanjaymala Rajendra Hatwar will approach before the concerned Tribunal at Gondia with appropriate application.
