No. 585/2026 in First Appeal No.873/2024 Coram : Registrar(Judicial) Dated : 24.02.2026 The civil application is filed by appellant under Order V Rule 20 of the C.P.C., 1908 for substituted service upon Respondent No.5 by way of paper publication. It is stated in the application that the Respondent No.5 could not be served for want of correct address. Further, it is stated in the application that the respondent No.5 is trying to avoid service of notice issued by Hon'ble Court. It is further stated in the application appellant do not have any other alternative address of Respondent No.5. Thus, the appellant wants to serve Respondent No.5 by way of paper publication.
Hence, considering the reasons mentioned in the application, the same is allowed. Substituted service be effected upon Respondent No.5 by publishing a notice in widely circulated local daily newspaper 'Dainik Bhaskar (Marathi)", Nagpur Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.
