By this application, the applicant seeks substitution of name of respondent No.3 - Executive Engineer, Public Works Department No.02, Marg Prakalp Vibhag, Near Shashkiya Vishram Gruh, Tah. & Dist. Gondia - 441614, on the ground that now the land is handed over to the Project Officer, National Highway Authority of India, which needs to be impleaded as party respondent.

Learned AGP appears on behalf of respondent Nos.1 and 2 and he does not dispute the said position. 3.

In view of above, the civil application is allowed. Applicants/Appellant are permitted to substitute the name of respondent No.3 by mentioning the authorities' name as mentioned in para No.8 of the said application. Necessary amendment be carried out within a period of one week from today.

After the amendment is carried out, issue notice to the newly added respondent, returnable after four weeks. 5.

Appellant is permitted to serve the newly added respondent by private mode, in addition to regular mode of service and file affidavit of service in that regard by next date.
