Appellant no.2 -Smt. Kaushalyabai Wd/o Kisanji Chawre, the mother of deceased Shailendra Chawre, died on 31.08.2024. Her death certificate is also placed on record along with the application.

It is contended in the application that appellant nos.1, 3 and 4 are the only legal heirs of deceased Shailendra. The first appeal has been withdrawn by the appellants in Lok-Adalat. As per the shares determined by the impugned award, appellant no.1 is granted 40% amount and appellant nos.2 to 4 are granted 20% each of the amount of the award.

Therefore, appellant nos.1, 3 and 4 are permitted to withdraw their respective share along with accrued interest. Apart from it, appellant nos.1, 3 and 4 are also granted equal share in the share fell in favour of deceased appellant no.2 i.e. 20% amount of the award and they are

Registry to act accordingly.

The application is allowed and disposed of. No costs.
