This is an application seeking permission to withdraw the balance amount of compensation.

The contention is that respondent no.3 is suffering from mouth cancer. A certificate of the laboratory of Dr. Sujata G. Moghe has been filed on record. The record shows that 50% of the decretal amount is already withdrawn by the claimants.

Considering the reason mentioned in the application, respondent no.3 is allowed to withdraw his 1/6th share in the remaining 50% amount of compensation along with accrued interest, on furnishing usual undertaking.

The application is allowed and disposed of.
