JUNE 12, 2025 1) The applicant/respondent No.3 has filed Civil Application No.1843/2025 for permitting it to deposit the entire compensation amount along with interest as awarded, in this Court, within a period of two weeks from today. 2) Learned counsel for the applicant/respondent No.3 submitted that a Cheque is ready and he is going to deposit the same during the course of the day.
3) It also appears that the original applicant/appellant moved Civil Application No.1844/2025 for permitting him to withdraw the amount deposited by respondent No.3 in this Court.
4) On perusal of the order dated 30/11/2024, it appears that before the Lok Adalat both the parties had agreed to deposit the awarded amount along with interest in the District Court, Yavatmal within six months from the date of Award, however, the
2 05-CAF 1843.2025 + 1.odt respondent No.3 has not deposited the same in time, therefore, moved Civil Application No.1843/2025.
5) Having considered the above facts, it would be appropriate to allow Civil Application No.1843/2025. Accordingly, the application is allowed, and the applicant/respondent No. 3 is permitted to deposit the entire amount, including interest as awarded, in this Court by 16/06/2025.
6) Upon depositing and encashment of the said amount, it will be transferred to the District Court, Yavatmal, immediately for disbursement.
7) On receipt of the said amount, the District Court, Yavatmal shall disburse the same along with interest to the appellant/original applicant as per the Award. 8) Both applications are accordingly disposed of. 9) Inform the District Court, Yavatmal, accordingly.
