This is an application for condonation of delay of 100 days in filing the statutory appeal.

In response to the notice on this application, Advocate Mr. Jain, appears and waives for respondent Nos.1 to 3. Nobody appears on behalf of respondent Nos.4 and 5, although served.

Learned counsel for the applicant submits that the delay occurred on account of compliance of administrative approvals and permissions in filing the statutory appeal. 4.

Having regard to the contents of the application and submissions advanced, the delay of 100 days does not appear to be intentional and the application needs to be allowed in the interest of justice. Accordingly, the civil application is allowed. Delay of 100 days in filing the statutory appeal is hereby condoned. First appeal be registered.
