By the present application, the respondent nos.1, to 3/original Claimants seek permission to withdraw the compensation amount granted under judgment and award dated 23rd February, 2023 passed in MACP No.196/2016 by the learned Chairman, Motor Accident Claims Tribunal, Yavatmal.

The learned counsel appearing for the Appellant has strongly opposed the application.

Taking into consideration, the daily needs of respondent nos.1 to 3 as well as accidental death of earning member in their family, it would be just and proper to permit the Claimants/respondent nos.1, to 3 to withdraw 50% of their respective share of the claim amount, upon furnishing the usual undertaking to the satisfaction of the Registry of this Court.
