By this application, the applicant/appellants seek condonation of delay of 165 days caused in filing application for setting aside abatement and bringing legal heirs of deceased appellant no.3 on record.

Considering the reasons mentioned in the application and the length of delay, the delay is condoned. Since, the right to proceed in the matter survives against the legal heirs of deceased appellant no.3, the abatement order is set aside. The names of the applicants/legal heirs of deceased appellant no.3 is permitted to be brought on record.

Necessary amendment be carried out within three weeks.

The application is allowed and disposed of.
