Hence, considering the reasons mentioned in the application, substituted service be effected upon aforesaid respondent by publishing a notice in widely circulated local daily newspaper 'Deshonnati (Marathi)' Gondia Edition in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.

472/2024 IN F.A. ST. NO. 348/2024 The civil application is taken out for grant of permission to delete deceased R.No. 5 from record. It is stated in the application that R.No. 5Tryambak S/o Chintman Onkar has died on 24/04/2024. It is further stated that the legal heirs of deceased R.No. 5 are already on record and there is no other legal heirs of the deceased who are in the knowledge of the appellant. Hence, the appellant prays for deletion of name of R.No. 5 from the array of respondents.
Hence, the civil application is formal in nature and supported by affidavit. The same is allowed. Counsel for the appellant has granted permission to delete the name of R.No. 5 at his own risk.
