By these civil application, the appellant seeks condonation of delay in filing application for bringing legal heirs of deceased respondent no.1, for setting aside abatement and bringing legal heirs of deceased respondent no.1 on record.

Considering the reasons mentioned in the application and the fact that the contents of the applications remained uncontroverted, the delay in filing application for bringing legal heirs of deceased respondent no.1 is condoned. Since, the right to proceed survives in favour of the legal heirs of respondent no.1, the abatement order is set aside. The legal heirs of deceased respondent no.1 are permitted to be brought on record. 4.

Necessary amendment be carried out within one week.
