This is an application for grant of permission to withdraw the amount 50% each to respondent Nos.2 and 3, which is deposited by the appellant as per the requirement of Decree Section and Nazarat.

It is submitted that an amount of Rs.7,04,130/- came to be deposited vide Pursis No.10607 of 2018 dated 10.08.2018 in the Registry of this Court. It is submitted that respondent Nos.2 and 3 had filed civil application No.2264 of 2024 for permission to withdraw the deposited amount along with accrued interest. On 02.09.2024, this Court had permitted to respondent Nos.2 and 3 to withdraw the said amount. However, the Decree Section raised an objection that
2 10. CAF 3836 of 2025.odt the share of amount of respondent Nos.2 and 3 was not decided by the Court. Therefore, respondent Nos.2 and 3 are now approached before this Court by filing this application for permission to withdraw the amount 50% each.

Advocate Ms. Harshita Verma holding for Mr. H.N. Verma, learned Advocate for the appellant submits that she is having no objection to permit respondent Nos.2 and 3 to withdraw the amount 50% each.

In view of the above, the application is allowed. Respondent Nos.2 and 3 are permitted to withdraw 50% amount each deposited by the appellant.
