Learned Advocate for the applicant seeks leave to delete the name of respondent Nos.4 and 7, from the array of parties. 3.

This is an application for condonation of delay of 301 days in filing statutory appeal.

In response to the notice, Advocate Mr. Rajesh Nagpure, has appeared for the contesting respondents. Learned AGP appears for respondent Nos.1 and 2-State.

Learned Advocate for the applicant submits that the delay of 301 days occurred in the process of obtaining necessary approvals and permissions and arranging court fees for filing statutory appeal on behalf of the applicant 7.

Although the application is opposed by the respondents, on perusal of the contents of the application, it shows that the delay is not intentional and needs to be condoned in the interest of justice, however, subject to costs. Hence, the application is allowed and the delay of 301 days in filing statutory appeal is condoned, subject to costs of Rs.3,000/- (Rupees Three Thousand Only), to be deposited by the applicant in Public Welfare Account, which is ordered to be opened vide order dated 12.01.2026, passed in SMPIL No.01 of 2021, within a period of two weeks from today.
