By this application, the applicant-Insurance Company seeks condonation of delay of 115 days in filing the appeal challenging the judgment and award dated 03.05.2025 in E.C.A. No.20/2021 passed by the Commissioner under the Employees Compensation Act, Yavatmal.

In response to the notice on this application, Advocate Mr. Das, appears for respondent No.1 to 4. Nobody appears for respondent No.5, although served. 3.

Learned counsel for the applicant submits that the delay occurred on account of seeking necessary permissions and approvals in filing the statutory appeal. 4.

Having regard to the contents of the application and submissions advanced, the delay of 115 days does not appear to be intentional and the application needs to be

2 17-CAF-4105-2025.odt allowed in the interest of justice. Hence, the delay of 115 days is condoned subject to cost of Rs.3,000/- (Rupees Three Thousand Only) to be paid by the applicant to respondent Nos.1 to 4 within a period of four weeks from today.
