The learned Counsel appearing for Appellant states that in Claim Petition No. 746/2017 decided by the Motor Accident Claims Tribunal, Nagpur vide Judgment dated 21/9/2021, exonerated the Appellant/Insurance Company from the liability of payment of compensation.

In view of this, present Application is moved to withdraw the amount deposited before this Court along with interest accrued thereon.

In view of the averments made in the Application and the fact that learned Tribunal has exonerated the Insurance Company from the liability of compensation, Civil Application is allowed as prayed.
