It is pointed out that during the pendency of the present appeal, the appellant is reported to be dead on 18.08.2025. In view of the same, the present application is moved for setting aside the abatement against the appellant No.1 and to bring the present applicants as legal representatives of the deceased. The application is made on affidavit and filed the death certificate of the appellant. It is clear that they have right to sue survive in the present appeal. Hence, the application is allowed.

Necessary amendment be carried out in the appeal memo within a period of one week.
