This is an application for condonation of delay of 638 days in filing the statutory appeal.

Learned counsel for the applicants submits that the applicants are original claimants who had filed claim petition before the Railway Claims Tribunal, Nagpur, which was dismissed and the applicants/appellants are constrained to file this appeal.

It is submitted that the delay occurred for the reasons mentioned in the para Nos.4 to 6 of the civil application.

Although, learned counsel for the respondent opposed the application, however, considering the reasons mentioned in the application and the nature of the statute being a social welfare legislation, the delay of 638 days in filing the statutory appeal is condoned in the interest of justice.

In view of above, civil application is allowed and disposed of.
