It is stated that respondent no.2 - Smt. Anusayabai Krushnarao Mohod is reported to be dead and she has no legal heirs against whom the right to sue would survive.

Therefore, the counsel for the appellant seeks to delete the name of aforesaid respondent no.2 from the array of the respondents.

Considering the reasons mentioned in the application, the appellant is permitted to delete the name of respondent no.2. Necessary amendments be carried out in the cause title of the appeal.
