1] The learned counsel for the petitioner submits that in terms of agreements dated 1st July, 2021 and 1st August, 2021 is dispute arising out of the agreement, the same has to be settled through Arbitrator. Arbitration clauses i.e. Clause 6 and 12 of the respective agreements provides as under :

Any dispute arising between the Parties will be settled amicably through Arbitration.

He further submits that in terms of dispute between the parties, the petitioner has given notice to the respondent, however, the respondent has replied to the notice thereby denied to refer the matter to Arbitrator suggested by the petitioner. As such, the application is filed under Section 11

54.25AA of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator.

2] Issue notice to the respondents, returnable on 17.12.2025.
