The learned counsel for the applicant submits that the application is filed seeking extension of mandate of the arbitrator. He submits that mandate or arbitrator has expired and the present application is filed for extension of the mandate under Section 29A of the Arbitration and Conciliation Act, 1996. He submits that he moved this application in view of the earlier pronouncement of this court in the case of Sheela Chowgule and others Vs. Jagdeep Chowgule holding that this court has jurisdiction to extend the mandate. It is also pointed out that the Hon'ble Supreme Court in the case of Jagdeep Chowgule Vs. Sheela Chowgule and others,

2 ArbAppln.58.2025 2026 LiveLaw (SC) 89 has held that the mandate can be extended only by the court i.e. the District Court.

In the light of the law as laid down, this court would disposed of the application with liberty to the present applicant to move an appropriate application before the appropriate court. 4.
