This is an Application seeking permission to bring the legal representatives of deceased Respondent No.2 - Govindrao Ganpatrao Kale on record. Since there is a delay of 128 days in filing the Application, prayer is made for condonation of delay as also for setting aside abatement of Appeal against the Respondent No.2. The delay is properly explained in paragraph No.4 of the Application.

For the reasons mentioned in paragraph No.4 of the Application, the delay is condoned. Abatement of Appeal against the Respondent No.2 is set aside and permission is granted to bring the legal representatives of deceased Respondent No.2 on record.

Necessary amendment be carried out within a period of two weeks from today.
