The present application is filed seeking intervention on the ground that the applicants have purchased the suit property from respondent No.1 vide sale deed 15.12.2022, during the pendency of the present Second Appeal. Although the application is filed under Order I Rule 10(2) of the Code of Civil Procedure, 1908 (for short, "the CPC"), since the applicants have purchased the suit property during the pendency of the litigation, the application can be treated as one under Order XXII Rule 10 of the CPC.

In view of the aforesaid, application is allowed. Applicants be joined as respondent Nos.4 and 5 in the Second Appeal.

Necessary amendment be carried out before 18.04.2026.
