JANUARY 16, 2026 1) There is a delay of 311 days caused in filing Second Appeal. It is stated that the applicant No.1 who was looking after the matter was suffering from certain medical issues and therefore, there was a delay in contacting the Advocate for the purpose of filing the Second Appeal.

2) It is further stated that the case record was wrongly tagged by the Clerk of the Advocate representing the applicant in the first appeal with some other disposed of matter and therefore, the record could not be traced out for a long time. The respondents though served have not entered appearance. 3) In view of the above, delay of 311 days caused in filing Second Appeal is condoned. However, having regard to the delay, the applicants are directed to deposit costs of Rs.7500/- in the account of "Public Welfare Account" bearing Account No.129112010001014 IFSC Code : UBIN0812978 on or before 30/01/2026. Failure to deposit the costs within the aforesaid KOLHE
