C.A.S. NO. 937/2025 IN SECOND APPEAL NO. 329/2021 CORAM : REGISTRAR (JUDICIAL) DATED : 09/10/2025 The application is taken out for permission to correct/change the address of R.Nos. 3 and 5. As per application, notice could not be served upon aforesaid respondents for want of correct address. Thus, the appellants want to correct/change the address of aforesaid respondents.

Since the application is formal in nature, the same is allowed. Necessary amendment be carried out in the cause title of the matter. Thereafter, office to issue notice to the aforesaid respondents returnable within five weeks.

329/2021 The civil application is filed under Order V Rule 20 of the C.P.C., 1908 for substituted service upon R.No. 7 by way of paper publication. It is stated in the P.T.O.-

application that the aforesaid respondent could not be served for want of correct address. Thus, the appellants want to serve aforesaid respondent by way of paper publication.

Hence, considering the reasons mentioned in the application, substituted service be effected upon R.No. 7 by publishing a notice in widely circulated local daily newspaper 'Lokshahi Varta Marathi' in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.

There is further prayer regarding deletion of the name of R.Nos. 8 and 9 from the array of respondents. It is stated in the application that the aforesaid respondents were reported to be dead. Thus, the appellants want to delete the name of R.Nos. 8 and 9. The counsel for the appellants is permitted to delete the name of aforesaid respondents at their own risk. Necessary amendment be carried out in the matter.

Counsel to take steps for deceased R.No. 6 within a period of two weeks.
