NO. 940/2025 IN SECOND APPEAL NO. 324/2017 Coram : REGISTRAR (JUDICIAL) Dated : 09/10/2025 This application is filed by the appellant for bringing the legal heirs of the deceased appellantEknath s/o Vishwanath Ladikar on record. It is stated in the application that during the pendency of the second appeal, the appellantsole expired on 03/05/2025 leaving behind his heirs. Copy of death certificate is annexed with civil application. The application is supported by affidavit.

It is seen that appellant-sole expired on 03/05/2025 during the pendency of the matter and the present application is filed on 27/06/2025 i.e.

within time stipulated and right to sue survives.

Hence, the application is allowed.

Permission is granted to the appellant to bring the legal heirs of the deceased appellant-sole on record. Necessary amendment be carried out in the cause title of the matter.
