It is stated in the application that the aforesaid appellant expired on 21.01.2025 leaving behind his widow- applicant No. 1 and daughter and son-applicant Nos. 2 and 3.

Copy of Death Certificate is annexed with application. The application is supported by affidavit.

It is seen that Appellant No.

4 expired on 21.01.2025 during the pendency of the matter and the present application is filed on 06/03/2025 i.e.

within time stipulated and right to sue survives.

Hence, the application is allowed.

Permission is granted to the appellants to bring the legal heirs of the aforesaid deceased A.No. 4 on record. Necessary amendment be carried out in the cause title of the matter.

Counsel for the appellants to take steps against deceased R.No.

1(a) within two weeks.
