There is a delay of 219 days in filing Second Appeal. Office note dated 30.01.2026 shows that the sole respondent is served. However, there is no appearance on her behalf.

It is stated in the application that the appellant had earlier filed a petition challenging the impugned judgment and decree vide Writ Petition St. No.8950 of 2025 on 14.04.2025. The petition was obviously not maintainable and, accordingly, the same was withdrawn and thereafter the present appeal is filed.

The limitation for filing Second Appeal expired in the month of February, 2025. The delay that has occurred appears to be on account of improper legal advice given to the applicant.

In view of the aforesaid, application for condonation of delay is allowed.
