No. 1306/2025 in Second Appeal No.280/2016 Coram : Registrar(Judicial) Dated : 08.01.2026 The civil application is filed by appellants under Order V Rule 20 of the C.P.C., 1908 for substituted service upon legal heirs of deceased Respondent No.1 i.e. Respondent Nos.1 (i), (ii) & (iv) by way of paper publication. It is stated in the application that the appellants have tried to serve aforesaid respondents on their last known address but they could not be served. Thus, the appellants want to serve aforesaid respondents by way of paper publication.

Hence, considering the reasons mentioned in the application, the same is allowed. Substituted service be effected upon the aforesaid legal heirs of Respondent No.1 by publishing a notice in widely circulated local daily newspaper 'Hitvada'(English), in terms of Order V Rule 20 (1-A) of C.P.C., returnable within five weeks from the date of publication of notice.
