It is stated in the application that petitioner has made all bona fide efforts to serve R.No.

1, but petitioner has not received any response or acknowledgement from R.No. 1 and R.No. 1 has not received any copy of the contempt petition. It is further stated that the R.No. 1 being a formal party is not necessary for effective adjudication of the present contempt petition.

Thus, the petitioner prays to delete the name of R.No. 1 from the array of respondents.

Since the application is formal in nature and supported by affidavit, the same is allowed. The appellant is permitted to delete the name of R. No.1 at his own risk.
