Learned advocate for the present applicant/original non-applicant, submits that at the time of deciding main application (i.e. MCA No.949/24), his application i.e. CAO No. 1569/2024 filed for handing over interim custody of the daughters for the purpose of education, was not disposed of. He submits that similar application for interim custody of the daughters is pending before the learned 17th Joint Civil Judge, Senior Division, Nagpur, in HMP No. 223/2024, which is now transferred to the Court of Civil Judge, Senior Division, Hinganghat.

Since, the main application for transfer has been decided and similar application for interim custody of the daughters is pending before the learned 17th Joint Civil Judge, Senior Division, Nagpur (now transferred to the Court of Civil Judge, Senior Division, Hinganghat), this
2 15 cao62.25.odt application for interim custody (CAO No. 1569/24) does not survive. It is accordingly disposed of.

Learned Judge, to whom the proceedings of HMP No. 223/2024 is assigned, shall see that the interim custody matter is decided at the earliest.
