The present Application is moved for early hearing of First Appeal No. 81/2022 and Cross-Objection No. 35/2022. 2.

The Appeal is admitted on 19/4/2023. While admitting the Appeal this Court has stated that the Appeal will be taken up for final hearing in its due turn.

The Respondents, who are the Original Claim Petitioners and Appellants in Cross-Objection have filed the present Application seeking early hearing on the ground that the Respondent No.4 alone is aware about all the facts of the case and he is suffering from certain ailments. It is stated that it will be difficult for the Respondents/Original Claim Petitioners to contest the Appeal without active assistance of the Respondent No.4. The Appeal has to be argued on the basis of record.

In that view of the matter, no case is made out for early hearing at present. With liberty to make a motion for early hearing after a period of two years, Civil Application is rejected. (ROHIT W.
