MARCH 18, MARCH 18, (1) The present Application is filed for condonation of delay of 245 days in filing the Application for restoration of Review Application i.e. Misc. Civil Application (St) No. 1276/2024. The registration of the Review Application was refused by the conditional order dated 02/05/2024 passed by the learned Registrar (Judicial), due to nonremoval of the office objections. It is stated in the present Application that the earlier Counsel for the Applicant was unable to keep track of the matter and to take necessary steps within the stipulated period of 14 days. As the Applicant - Company was not informed about the same by its Counsel, it could not take steps to restore the Review

Application within the stipulated period. The Application is supported by the affidavit of Advocate.

(2) As such, I am inclined to allow the Application subject to payment of costs as no due diligence is shown by the learned Advocate.

(3) For the reasons stated in the Application, the Application is allowed. The delay in filing the Application for restoration of the Review Application is hereby condoned and Registry is directed to register the Misc. Civil Application (St) No. 4103/2025, subject to payment of costs of Rs. 1000/- to High Court Bar Library, Nagpur within a period of one week from today.

(4) The Application stands disposed of.

MISC. CIVIL APPLICATION ST NOS. 4103/2025 & 1276/2024 MISC. CIVIL APPLICATION ST NOS. 4103/2025 & 1276/2024 (5) The present Applications are filed for restoration of the Review Application in Misc. Civil Application (Arbn) No. 408/2020. The registration of the Review Application was refused by the conditional order dated 02/05/2024 passed by the learned Registrar (Judicial), due to non-removal of the office objections. Misc. Civil Application (St) No. 4103/2025 is supported by the affidavit of Advocate.

(6) For the reasons stated in the Application, the Application is allowed. The order dated 02/05/2024 passed by the learned Registrar (Judicial) is hereby quashed and set aside. Registry is directed to register the Misc. Civil Application (St) No. 1276/2024 on its original stamp number, subject to payment of costs as directed above in Civil Application (O) No. 301/2025.

(7) After registration of Misc. Civil Application (St) No. 1276/2024, the Applicant to remove the office objections within a period of two weeks.

(8) The Applications stand disposed of.
