The present Application is filed for condonation of delay of 896 days in filing the Application for restoration of Writ Petition (St.) No. 538/2022. The registration of the Writ Petition was refused by the conditional order dated 29/08/2022 passed by the learned Registrar (Judicial), due to non-removal of the office objections. It is stated in the Application that due to inadvertent mistake of the Clerk of the Counsel, the matter could not be noted and it remain unattended, and hence, the office objections could not be removed.
(2) Though I am not satisfied with the reason put-forth by the Applicants, however, in the interest of justice, I am inclined to allow the Application subject to payment of costs as no due diligence is shown by the learned Advocate for the Applicants as well as the Applicants. (3) As such, the Application is allowed. The delay in filing the restoration Application is hereby condoned and Registry is directed to register the MCA, subject to payment of costs of Rs. 3000/- to the High Court Bar Library, Nagpur within a period of three weeks from today. (4) The Application stands disposed of.

The registration of the Writ Petition was refused by the conditional order dated 29/08/2022 passed by the learned Registrar (Judicial), due to non-removal of the office objections. (6) For the reasons stated in the Application, the Application is allowed. The order dated 29/08/2022 passed by the learned Registrar (Judicial) is hereby quashed and set aside and Registry is directed to restore the Writ Petition on its original stamp number, subject to
payment of costs as directed above in Civil Application (O) No. 325/2025. Learned Registrar (Judicial) to verify whether the costs is paid before restoration of the Writ Petition. (7) After restoration of the Writ Petition, the Petitioners to remove the office objections within a period of two weeks. (8) The Application stands disposed of.
