Learned counsel for the applicant submits that, vide order dated 22.09.2025, this Court had observed that in the event the respondents failed to appear, the matter would proceed ex parte. Today, when the matter was called out, none appeared on behalf of the respondents. Hence, the Court proceeds ex parte against the respondents.

The learned counsel for the applicant has filed the present application under Sections 29A(4) and 29A(6) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as "the Act of 1996"), seeking extension of time for completion of arbitral proceedings, or in the alternative, substitution of the Arbitrator.

It is submitted that the matter before the learned Arbitrator is currently fixed for hearing under

2 13-cao-687-2025.odt Section 17 of the Act of 1996. It is further submitted that as per the mandate of Section 29A(1) of the Act, the arbitral award is required to be passed within a period of twelve months from the date the Arbitral Tribunal enters upon the reference. The parties had earlier mutually agreed to extend the said period. A further extension of one year is now sought for conclusion of the arbitral proceedings.

Considering the submissions and in the interest of justice, the request for extension is allowed. The period for completion of the arbitration proceedings before the learned Arbitrator is extended by a further period of one year from today.

In view of the above, the alternative prayer for substitution of the Arbitrator does not survive, and no further orders are required in that regard.

The Civil Application stands disposed of accordingly.
