By these applications, applicant prays for condonation of delay of 532 days and restoration of the petition whose registration was refused for non-removal of office objections. 2.

Mr. Nagsen Gawai, learned counsel for the applicant-petitioner submits that the counsel for petitioner is from Amravati and after the petition was filed there was no communication from the concerned clerk who was looking after the process of filing and removal of objections. He submits that on account of mis-communication the objections remained to be removed and the registration of the petition stood refused. He submits that the petitioner wants to contest the petition on merits and, therefore, the petition needs to be restored. As regards delay he submits that the delay occurred because the applicant had no knowledge about refusal of registration and

Considering the contentions mentioned in the civil application and the submissions advanced, the delay of 532 days caused in filing restoration application is condoned, subject to payment of costs of Rs.2,000/- to be paid to the High Court Bar Library, Nagpur within a period of two weeks from today and the writ petition be restored on its original file. 4.

The applicant-petitioner is also directed to remove office objections within a period of two weeks from today. 5.

Both the applications are accordingly allowed and disposed of.
