This is an application for condonation of delay of 47 days caused in filing the appeal.

Learned counsel for the appellant submits that the reasons of delay are mentioned in paras 3 and 4 of the application.

Mr. L.B. Khergade, learned counsel appearing for respondent vehemently opposed the contentions advanced by the learned counsel for the appellant. He submits that even if the averments made in the application are taken into consideration in a whole, there is no cause have been mentioned for condoning the delay.

However, having appreciated the contentions canvassed by the learned counsel for the appellant, we are satisfied that the delay caused of 47 days in filing the appeal needs to be condoned.

In that view of the matter, the application is

The delay of 47 days caused in filing appeal is condoned.
