NO. 38/2003 CORAM : REGISTRAR (JUDICIAL) DATED : 12/11/2025 The application is taken out by Defendant Nos. 2 to 5 seeking return of original lease-deed with map. As per the application, the defendants had filed original documents on record. The present suit came to be decided in favour of Defendant Nos. 2 to 5 by this Hon'ble Court by judgment and order dated 09/06/2025. Thus, the defendant Nos. 2 to 5 being owners of the land need to get back in their possession the original lease-deed dated 01/01/1988 alongwith map.
It is further stated that the appeal period expired long back, and as no appeal has been filed, the original documents as demanded by aforesaid defendants can be returned/handed over back to them as per power conferred on Registrar (Judicial) as per Chapter 2, Rule 3(z) of the Bombay High Court Appellate Side Rules, 1960.
In the office note, it is stated that after verification of record, it is seen that the original lease-deed dated 01/01/1988 and map is filed by Defendant Nos. 2 to 5 on 18/04/2009 and exhibited at 114 in examination-in-chief on 16/07/2011. It is further stated in the office note that the appeal period expired long back and no appeal has been filed.
Since the application is formal in nature and as according to the office note, appeal period has already expired and appeal has not been preferred, the original lease-deed can be returned to the applicants. Therefore, the application is allowed. Defendant Nos. 2 to 5 are permitted take back their original lease deed with map filed by them. The office shall keep true copy of lease-deed with map on record and shall obtain necessary acknowledgement from Defendant Nos.
