The learned counsel for the applicant has moved the present application seeking permission for substituted service under Order V Rule 20 of the Code of Civil Procedure, 1908. It is submitted that despite repeated and diligent attempts, the notices could not be served upon the non-applicants in the ordinary manner. It is further submitted that the non-applicants are deliberately avoiding service, thereby necessitating recourse to substituted service as contemplated under Order V Rule 20 CPC.

Having perused the averments made in the application and the material placed on record, this Court is satisfied that the requirements of Order V Rule 20 of the Code of Civil Procedure are duly fulfilled. The Court is of the opinion that the ordinary mode of service is not practicable and that substituted service is warranted to ensure due notice to the non-

2 16-mca-166-25.odt applicants and to prevent frustration of the proceedings.

Accordingly, for the reasons stated in the application and in exercise of powers under Order V Rule 20 of the Code of Civil Procedure, the application is allowed. The applicant is permitted to effect substituted service upon all the non-applicants by publication of notices in widely circulated newspapers, namely Lokmat or The Hitavada.
