We have heard the learned counsel for the applicant and perused the application.

The impugned judgment and decree was passed on 03.06.2025 and a certified copy was applied on 04.06.2025 which Rajeshri Aher

22 IA 67 OF 2026.DOC was delivered on 11.06.2025. The application proceed to state that the Appeal ought to have been filed on or before 09.09.2025, but, there has occasioned a delay and the reason thereof are to be found in paragraphs 3 and 4 of the application. 3.

We have perused the reasons stated in the application and since the applicant has shown sufficient cause for not filing Appeal within a prescribed period of limitation, we deem it appropriate to condone the delay of 94 days.

Interim Application is made absolute in terms of prayer clause (a).

As far as the other reliefs in the applications are concerned, they will have to be separately claimed as the present application only seek condonation of delay.

The appeal is directed to be registered.

Issue notice of Appeal to the respondent along with Interim Application Nos. 68 of 2026 and 69 of 2026, by making it returnable on 27.02.2026.

In addition to Court notice, notice is also permitted to be served through private mode of service.
