P.C.:
1.
Heard Mr. Mishra, learned Advocate for Appellants and Mr. Gala, learned Advocate for Respondent No.3.
2.
After I heard present Appeal From Order, I expressed my mind to Mr. Mishra, upon which after taking appropriate instructions
18.AO.56.2026+.doc Mr. Mishra would persuade the Court to give leave and liberty to the Appellants - Plaintiffs to approach the Trial Court with Application seeking injunctive reliefs against Defendants who have received possession of the re-habilitation / redeveloped suit premises from creating any third party rights until the Suit proceedings are decided. 3.
Such leave and liberty is always available to the Appellants - Plaintiffs to be exercised before the Trial Court and if the Appellants - Plaintiffs so exercise the same, learned Trial Court shall determine the same strictly on its own merits and in accordance with law after hearing both the parties.
4.
All contentions of Appellants - Plaintiffs are expressly kept open without this Court giving any imprimatur on facts or opinion on merits of the matter which shall be available to the Appellants - Plaintiffs before the Trial Court.
5.
Equally, all contentions of Defendants are also kept open before the Trial Court.
6.
Both Appeal From Orders are disposed in the above terms. 7.
In view of disposal of Appeal From Orders, both pending Interim Applications are accordingly disposed. [ MILIND N. JADHAV, J. ] by AJAY TRAMBAK UGALMUGALE Date: 2026.02.23 18:06:40 +0530 Ajay AJAY TRAMBAK UGALMUGALE
