This application is for restoration of appeal against respondent No.2 which came to be dismissed by Registrar (Judl.-II) by an order dated 12/07/2024 for the reason that the Appellant has failed to take steps against respondent No.2. Since respondent No.2 is not served yet notice of this application of the respondent No.2 is dispensed with. For the reasons mentioned in the application, appeal stands referred against Respondent No.2.

Learned Counsel for the Appellant undertake to take steps to serve respondent No.2 within a period of eight weeks. On the basis of the said undertaking, application stands allowed in terms of prayer clause A and B.
