By this Interim Application, the Original Petitioner/Applicant has sought condonation of delay of 260 days in filing of the Interim Application seeking setting aside of the order dated 19 April 2024 passed by the Registrar (Judicial-I) rejecting the above Writ Petition for non removal of office objections and for restoration of the Writ Petition. 2.

The Applicant has in the Interim Application stated that the Advocates for the Applicant failed to remove office objections which were raised when the Writ Petition was filed. The same could not be removed within the stipulated period, in view of which the Writ Petition came to be rejected.

There is no opposition to the Interim Application by the RespondentState. Considering that we are inclined to allow the Interim Application, no prejudice would be caused to the other Respondents though not served. The Applicant being a person should not be made to suffer on account of default of his Advocate in non removal of office objections. Hence, the following order:-

ORDER

i.

The delay in filing of the Interim Application is condoned. ii.

The order passed by the Registrar (Judicial-I) rejecting the Writ Petition (St) No.6620 of 2023 is set aside.

iii.

The Writ Petition (St) No.6620 of 2023 is restored to file. iv.

The Petitioner shall remove the office objections within a period of three weeks within a period of three weeks from the date of uploading of this order. Failure to remove the office objections shall result in the Writ Petition rejected without reference to the Court.
