There is a delay of 52 days in filing the present Interim Application for restoration of the Appeal, which was dismissed for non-prosecution. 2.

The delay has been explained in paragraph 4 and being satisfied with the reason given, the delay is condoned.

In so far as non-appearance on 18th October, 2024 is concerned, in paragraph 2 it is stated that the Advocate appearing on behalf of the Appellant was admitted in the hospital and, therefore, he could not appear on that day. Being satisfied with the reason given, the First Appeal along with Civil Application is restored back.
